Welcome to The Jayne Elle Shop (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website, content, features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services. By visiting or purchasing from us, you agree to these Terms and our Privacy Policy.

1. Access & Account

You represent you are the age of majority in your jurisdiction, and you will safeguard your account credentials. You are responsible for all activity that occurs under your account. You may not transfer or license your account to any other person.

2. Product Information & Availability

We make every effort to accurately describe products. Colors and appearance may vary due to device settings. We may change, limit quantities, or discontinue products at any time without notice.

3. Orders, Acceptance & Cancellations

Your order is an offer to purchase. We may accept or decline any order at our discretion. We must process your payment before acceptance. Please review your order carefully—after acceptance we may be unable to accommodate cancellation requests. If we do not accept, make a change to, or cancel an order, we’ll attempt to notify you using the contact details provided at checkout.

Orders may be cancelled by you within 12 hours of purchase by emailing hello@thejayneelleshop.com. After this window, production may be underway and cancellation isn’t guaranteed.

4. Prices, Promotions & Billing

Prices, discounts, and promotions may change without notice. The price charged will be the price in effect at the time you place the order and appears on your confirmation email. Posted prices typically exclude taxes, shipping, duties, or import fees unless stated otherwise. You agree to provide current, complete, and accurate purchase and account information and authorize us to charge your chosen payment method for all amounts due.

5. Shipping, Title & Risk of Loss

We ship according to our Shipping Policy. Delivery dates are estimates only. Once we transfer items to the carrier, title and risk of loss pass to you. We are not liable for delays, loss, or damage caused by carriers, customs, or incorrect addresses provided at checkout.

6. Returns & Refunds

Because we produce in small, intentional batches, all sales are final. We only replace or provide store credit for items that arrive damaged, defective, or incorrect—as outlined in our Refund Policy. For issues, contact us within 7 days of delivery with order number and photos.

7. Intellectual Property

All content, logos, designs, and images are the property of The Jayne Elle Shop or its licensors and are protected by IP laws. You may not use any content without our written permission.

8. Optional Tools & Third-Party Links

We may offer access to third-party tools or link to external sites. These are provided “as is” without warranties. We do not control and are not responsible for third-party materials, policies, or practices. Your use is at your own risk.

9. Relationship with Shopify

Our store is powered by Shopify. Sales are made directly with The Jayne Elle Shop. Shopify is not responsible for your purchases or transactions with us. You release Shopify from claims arising from such transactions.

10. Privacy

Your submission of personal information is governed by our Privacy Policy and certain information may be processed by Shopify in accordance with its privacy terms.

11. Feedback & Reviews

If you submit ideas, reviews, or other content (“Feedback”), you grant us a worldwide, perpetual, sublicensable, royalty-free license to use, reproduce, modify, publish, and display such Feedback for any purpose. You represent you own or have rights to your Feedback and that it complies with applicable laws and these Terms.

12. Errors, Inaccuracies & Omissions

Occasionally information on the Services may contain errors or omissions (e.g., descriptions, pricing, availability). We reserve the right to correct, update, or cancel orders if any information is inaccurate at any time without prior notice.

13. Prohibited Uses

You may not use the Services for any unlawful purpose; to infringe IP rights; to harass, defame, or harm others; to transmit malware or spam; to scrape or crawl; to misrepresent identity; or to interfere with security features. We may suspend or terminate access for violations.

14. Termination

We may terminate or suspend access at any time. You remain liable for amounts due up to the termination date. Sections intended to survive (including IP, Feedback, Disclaimers, Liability, Indemnification, Assignment, and Governing Law) do survive.

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms without restriction.

19. Governing Law & Venue

These Terms are governed by the laws of the United States and the state in which The Jayne Elle Shop is headquartered (without regard to conflict-of-law rules). You consent to exclusive jurisdiction and venue in those courts.

20. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page and, where required, we will provide additional notice. Continued use of the Services after changes constitutes acceptance.
